By accessing or using the software applications, websites, and digital tools (collectively, the "Service") provided by SWS Strategic Media LLC ("SWS," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
SWS Strategic Media LLC operates a digital horticulture utility and plant-tracking software platform. Our Service includes web-based plant management dashboards, environmental monitoring integrations, pattern-matching educational games, procedural digital collectibles, and subscription-based premium features. We provide informational horticultural data and software tools designed to assist users in tracking and managing their gardens and indoor growing environments.
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to update such information as necessary. You must be at least 18 years of age to create an account.
SWS offers both free and premium subscription tiers. Free accounts include access to core plant tracking features with limitations on the number of tracked plants. Premium subscriptions ("Stevie Vision") provide expanded features including unlimited plant tracking, enhanced photo timelines, priority environmental alerts, and consultation services. Subscription pricing, billing intervals, and specific features are described at the time of purchase. Subscriptions may be cancelled at any time, and cancellation takes effect at the end of the current billing period.
The Service may include procedurally generated digital collectibles ("Hash Plants"), virtual currency ("Attention Hashes"), and cosmetic upgrades. These digital items exist solely within the Service environment. They have no monetary value outside of the platform, are non-transferable, and are not redeemable for cash or any form of legal tender. SWS reserves the right to modify, suspend, or discontinue any virtual item or feature at any time.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not: (a) use the Service to violate any applicable law or regulation; (b) attempt to gain unauthorized access to any portion of the Service or its related systems; (c) interfere with or disrupt the integrity or performance of the Service; (d) engage in any activity that could harm other users or the Service infrastructure.
All content, software, designs, graphics, procedural generation algorithms, and other materials available through the Service are the property of SWS Strategic Media LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
The Service integrates with third-party services including weather data providers, botanical databases, payment processors, and cloud infrastructure platforms. Your use of these third-party services is subject to their respective terms and privacy policies. SWS is not responsible for the availability, accuracy, or practices of third-party services.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. SWS does not warrant that the Service will be uninterrupted, error-free, or secure. Horticultural information provided through the Service is for educational and informational purposes only and should not be relied upon as professional agricultural advice.
To the maximum extent permitted by applicable law, SWS Strategic Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of (or inability to access or use) the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.
SWS reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on the Service with a revised "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
